  1. GENERAL CONDITIONS OF USE OF THE SITE

The use of the site  www.skinhaptics.com, hereinafter referred to as “the Site”, implies full acceptance of these general conditions of use by the “User”.

These conditions of use may be modified or supplemented at any time by the Company SKINHAPTICS  above presented and hereinafter referred to as “the Company”.

Likewise, the Company reserves the right to modify its privacy policy at any time.

Any modification will be notified to the User by updating the date appearing at the header of this legal notice and privacy policy.

The User of the Site is therefore invited to consult them on a regular basis.

  1. CONTRACTUAL LIMITATIONS ON TECHNICAL DATA

3.1. Use of the Site

The Site uses technology.

The Company cannot be held responsible for material damage related to the use of the Site. In addition, the User undertakes to access the Site using recent equipment, not containing viruses and with a browser of the latest generation updated.

3.2. Accessibility of the Site

This Site is normally accessible to the User at any time. An interruption due to technical maintenance may however be decided by the Site which will then endeavor to communicate to users in advance the dates and times of the intervention.

In any case, the Company acts as a distance selling company and not as an Internet access provider.

As such, it cannot guarantee either the quality of the connection to the Internet or the absence of interruptions specific to the network.

The Company cannot therefore be held responsible for any damage, whatever its nature, resulting from the unavailability of the Site.

Similarly, the Company does not incur any liability for any imprecision, inaccuracy, omission  or for any damage resulting from an  intrusion by a third party that has led to a modification of the information made available on the Site or making it impossible to access it.

  1. INFORMATION ON THE SITE

The Site has been created to provide Users with the presentation of the different ranges of the SKINHAPTICS brand.

In particular, the Site disseminates non-contractual Information without the intention of an offer to purchase a product or service directly (unless expressly stated otherwise).

The Site shall not constitute a contractual offer. The Site is free of charge and does not include in-app purchases.

The Site may offer opinions expressed by experts in a particular field in connection with the content of the Site or extracts from press articles. Such information is the sole liability of the expert consulted or the author of the article and does not necessarily reflect the opinion of the Company.

The Site may also contain information concerning health, physical condition, a medical field or medical treatments exclusively reserved for human use. This information does not constitute medical advice and is published on the Site for information purposes only.

Under no circumstances shall the User use this information to make a medical diagnosis concerning a disease or physical problem or to prescribe or use medicines. SKINHAPTICS is a registered trademark in I. N.P.I under the numbers 1408508 and 4381048.

Unless previously and expressly authorized by the Company, the User is prohibited from reproducing and/or using the trademarks, logos and more generally all the iconographic and photographic representations present on the Site as well as all downloadable documents. The User is also prohibited from modifying, copying, translating, reproducing, selling, publishing, exploiting and disseminating in a digital or other format, all or part of the information, texts, photos, images, videos and data present on this Site. Violation of these mandatory provisions subjects the offender, and all responsible persons, to the criminal and civil penalties provided for by the regulations in force.

Anyunauthorized use of the Site or any of the elements it contains will be considered as constituting an infringement and prosecuted in accordance with the provisions of Articles L. 335-2 and following  and L. 716-1 and following of the Intellectual Property Code.

  1. PERSONAL DATA – PRIVACY POLICY

In France, personal data is protected in particular by Law No. 78-87 of 6 January 1978 on data processing, files and freedoms, Law No. 2004-801 of 6 August 2004 on the protection of individuals with regard to the processing of personal data and European DirectiveNo. 95/46/EC of  24 October 1995 on the protection of individuals with regard to the processing of data to personal character and the free movement of such data.

Databases are protected by the provisions of Law No. 98-536 of 1 July 1998 transposing DirectiveNo. 96/9/EC of 11 March 1996 on the legal protection of databases.

On the occasion of the use of the Site, may be collected: the URL of the links through which the User accessed the Site,the User’s access provider, the Internet Protocol (IP) address of the User.

In any case, the Company collects personal information about the User only for the need of certain services offered by the Site.

In particular, the Company may use the data concerning the User and collected on its Site in the following ways:

  • to ensure that the content of the Site is presented in the most effective manner (display, navigation, etc.);

The User provides this information with full knowledge of the facts, in particular when he enters it himself.

It is then specified to the User of the Site the obligation or not to provide this information.

Data concerning contracts concluded with a merchant or a non-merchant are kept for the duration of the commercial relations for a maximum period of 5 years from the end of these relations (Article L.110-4 of the French Commercial Code).

In accordance with the Data Protection Act of 6 January 1978, the User has a right of access and rectification and opposition to personal data concerning him.

The User may indeed require that information concerning him that is erroneous, outdated or incomplete or whose collection or use, communication is prohibited, be modified, completed, clarified or deleted. To assert this right, the User will contact the Company’s Customer Service whose contact details are set out in Article 1 above.

This request must be signed and accompanied by a photocopy of an identity document bearing the User’s signature and must specify the address to which the response must be sent. A response will then be sent within two (2) months of receipt of the request.

The User may also lodge a complaint with a control body in order to dispose of his personal data.

  1. SECURITY AND LIABILITY

According to article 323-1 of the Penal Code, any fraudulent access to the Site is prohibited and punishable by law.

In his publications, the member undertakes to respect the rules of law in force.

The Site exercises a priori moderation on publications and reserves the right to refuse their online publication, without having to justify it to the member.

The User remains the owner of all his intellectual property rights.

The publishing company undertakes to include the name of the member near each use of its publication.

11.2. Obligations of Users

  • upload, post, transmit by e-mail or in any other way any in violation of any patent, trademark, trade secret, intellectual property right or other proprietary right belonging to others;
  • disrupt the normal flow of dialogue, speed up the pace of screen scrolling in such a way that users are unable to follow and type their dialogue, or commit any action with a similar disruptive effect that hinders users’ ability to communicate in real time;
  • interfere with or disrupt the service, servers, networks connected to the Site or refuse to comply with any requirements, procedures, general rules or regulatory provisions applicable to the networks connected to the Site;
  • harass in any way another or more other Users;
  • collect and store personal data, identification data, relating to other Users.

The Company shall be entitled to remove or remove any content that violates the terms here of this Agreement and/or applicable regulations and/or is otherwise objectionable.

Users also acknowledge that they must exercise discernment and bear all the risks related to the use they make of the information on the Site.
